State preparing a case to sue for damages over dementia death

LOS ANGELES: A legal opinion sought from a prominent practitioner confirms the state can sue a skilled nursing home for failing to monitor a man suffering from dementia. The man left the home and was later found dead.

The original investigators said the home failed to monitor the resident adequately. He was found dead in a field three days later. Investigators also said that the home’s failure to monitor had the potential to impact at least 10 other residents who were also suffering from Alzheimer’s and had a history of trying to leave.

Investigators recommended that the case be referred to the police. They also wanted to issue civil penalties, saying the company that owned the home had violated the minimum standards for assisted living facilities…
