NEW YORK: Earlier this week, a lawsuit was filed against an assisted living facility for its use of an “unlawful employment exam” that allegedly discriminated against employees on the basis of their national origin.
According to the complaint, the respondant began requiring all personal care providers to complete a written exam as part of a training course. The assisted living provider “did not complete any formal job analysis of the essential skills or job duties necessary to perform the position, before or as part of developing the exam…”
