Appeal court dismisses lawsuit by former Assisted Living CEO

legalMIAMI: A lawsuit filed against the securities authorities by a former chief executive has been dismissed by an appeals court.

The ex-CEO of a major assisted living group in January sued after it alleged that she and the company’s former chief financial officer directed employees to report fradulent occupancy rates at some company’s assisted living centres to avoid violating lease agreements.

The lawsuit challenged the decision to bring the case before an administrative law judge instead of a federal judge and jury.
